Update – Cemetery Court Case Injunction Hearing

Update following the Injunction Hearing held earlier today at the Royal Courts of Justice, London. Full report to follow soon.
Comments from the Town Mayor, Cllr Simon Whittaker:
‘’It’s been a great result for MTC. We’ve got the result we requested. If they don’t comply then we are back here in court. Thanks to the staff and legal team for putting this together and it’s been a long time in the making. Both myself and the Clerk have worked on this for the last 10 months. Without Safia we would have embarked on a journey that would have been illegal and in breach of local government acts’’
Comments from the Town Clerk, Safia Kauser:
‘’The Judge indicated that the agenda for today would be the agenda set by the Judge and today’s judgement has confirmed that Middewich Town Council is the statutory burial authority and the Tomlin agreement would be in breach of the local government act 1972 section 101 as argued as part of our claim relating to the fresh proceedings’’.
‘’We have secured the injunction orders we requested to ensure that there will be financial, documentation, banking and associated equipment to be handed over and confirmation by affidavits. Further directions for a full trial have been agreed with a date of a two day hearing to be confirmed for December’’.
